Consumer Complaint in Kolkata: Evidence and Online Filing Checklist
A useful consumer complaint connects five things clearly: the transaction, the promise made, the defect or deficiency, the resulting loss, and the relief requested. Organising that chain before filing reduces avoidable objections and makes the record easier to understand.
Legal information notice: This guide is general information, not advice for a particular dispute. Jurisdiction, limitation, valuation, procedure and available relief depend on the facts and current law.
First confirm that the record supports a consumer dispute
Identify who supplied the goods or service, who paid, what was represented, what was delivered, when the problem became known, and how the business responded. Preserve the invoice, order page, warranty, advertisement and terms as they appeared at the relevant time. If the transaction involved a business purpose, resale, insurance, housing, travel, healthcare, banking or an online marketplace, obtain specific advice on the correct forum and parties.
Build an evidence file
- Transaction: invoice, receipt, order confirmation, payment reference and bank or card record.
- Promise: advertisement, product description, proposal, warranty, service-level term or written assurance.
- Defect or deficiency: photographs, video, inspection report, service history, error messages or independent records.
- Notice: emails, chats, complaint numbers, escalation messages, legal notice and every response.
- Loss: refund calculation, repair cost, consequential expense and supporting proof.
- Relief: a precise statement of refund, replacement, repair, compensation, costs or other remedy sought.
Keep originals safely. Export chats and emails where possible, retain complete message threads, and avoid editing screenshots in a way that removes dates, sender details or surrounding context.
Check forum, jurisdiction and limitation before filing
The appropriate Consumer Commission and filing route depend on current statutory rules, the value and nature of the claim, the parties, territorial connections and the dates. Do not choose a forum only because it is nearby. Record the purchase date, delivery date, complaint dates, refusal date and any later acknowledgment so limitation can be assessed from an accurate chronology.
Prepare the online filing packet
- Create a one-page chronology with dates and document references.
- List every opposite party using the correct legal name and service address.
- Draft numbered facts that match the supporting annexures.
- State the legal grievance and the exact relief requested without exaggeration.
- Prepare a legible, indexed PDF set and keep file names consistent with the annexure list.
- Review declarations, fee, verification and service requirements on the current portal before submission.
The Department of Consumer Affairs administers the e-Jagriti portal for online consumer case services. Portal screens and filing requirements can change, so verify the current workflow at the time of filing.
Common filing problems
- Using screenshots without the full conversation or transaction reference.
- Naming a brand but omitting the actual seller, service provider or contracting entity.
- Claiming a lump sum without showing how it was calculated.
- Uploading unreadable annexures or using inconsistent page numbers.
- Ignoring an arbitration, jurisdiction or limitation issue in the governing terms.
- Filing before giving the business a clear opportunity to respond where that step is useful.
