Article 226 gives High Courts a broad constitutional power to issue directions, orders, and writs. A successful filing still requires careful attention to the legal right asserted, the public-law error alleged, territorial jurisdiction, the correct respondents, available statutory remedies, delay, disputed facts, and the relief the Court can practically grant.

Start with the decision or inaction being challenged

Identify the order, notice, proceeding, refusal, or failure to perform a legal duty. The record should show who acted, under which power, when the action occurred, how the petitioner is affected, and what legal or procedural error is alleged. A writ petition should not be used as a substitute for a complete factual record.

Check territorial jurisdiction and the correct respondents

The petition should explain the material facts connecting the cause of action to the Court’s territorial jurisdiction. The authority whose action is challenged, and every party whose rights may be directly affected by the requested order, should be considered at the outset. Incorrect or incomplete parties can delay urgent relief and create avoidable objections.

Alternative remedy: important, but not an automatic jurisdictional bar

Where legislation provides an effective appeal, revision, review, tribunal, or other statutory process, the High Court will ordinarily consider whether that route should be used first. The rule is one of judicial policy and discretion. Supreme Court decisions recognise established situations in which a writ may still be examined, including enforcement of fundamental rights, violation of natural justice, action wholly without jurisdiction, or a challenge to the validity of legislation. The facts must genuinely support the exception; merely describing a matter as urgent is not enough.

Questions that affect maintainability

  • Is the challenged conduct attributable to the State, a public authority, or a body performing a relevant public duty?
  • Does the governing statute provide an effective and timely remedy?
  • Is the complaint about jurisdiction, procedural fairness, reasons, legal duty, or another public-law error?
  • Would the case require extensive oral evidence or resolution of sharply disputed private facts?
  • Was the petition filed promptly, and can any delay be explained?
  • Would the requested relief prejudice an unjoined person?

Prepare a decision-focused court record

Collect the impugned order or notice, governing statute and rules, representations already made, proof of service, replies, hearing record, connected proceedings, statutory-remedy details, and a date-wise chronology. Annexures should be legible, relevant, consistently referenced, and arranged so the Court can follow the decision-making process.

Interim relief must support the final case

An interim request should identify the immediate prejudice, explain why later relief may be inadequate, address the balance of convenience and effect on public administration or third parties, and propose an order that can operate until the petition is heard. The interim prayer should not exceed or contradict the final relief.

Filing and current court practice

Original Side and Appellate Side requirements, classification, affidavits, service, court fees, e-filing, defect removal, urgency procedure, and bench determination must be checked against the current Calcutta High Court rules and notices. A correct legal argument can still lose time if the filing record is incomplete or placed in the wrong procedural category.
