Calcutta High Court Original Side Civil and Commercial Matters
Original Side filing requires more than a Kolkata address or a high claim value. Territorial, pecuniary and subject-matter jurisdiction must be established from the pleaded facts, relief and governing law. Commercial classification, arbitration, company, probate or other special jurisdictions may introduce separate rules.

A jurisdiction note should cite the material facts supporting the chosen forum and identify any fact that remains uncertain. Filing first and investigating jurisdiction later can create avoidable objections, delay and cost.

Commercial classification changes the preparation standard
The Commercial Courts Act, 2015 defines commercial disputes, specified value, Commercial Divisions and Commercial Appellate Divisions. Section 12A addresses pre-institution mediation in qualifying matters that do not contemplate urgent interim relief. Section 16 applies the amended civil procedure for commercial disputes. The Calcutta High Court Commercial Courts Practice Directions supplement that statutory and procedural framework.
The claim should therefore be classified before filing. The file may need a statement of truth, complete document disclosure, admission and denial planning, an explanation of urgent interim relief and a clear account of pre-institution mediation where applicable. A commercial label should not be used merely because a business is a party.

Prepare the case theory and document set together
The Code of Civil Procedure, 1908 and applicable Original Side rules shape the plaint, applications, affidavits, service and later stages. The document set should support jurisdiction, limitation, cause of action, valuation and every material relief.
- Draft a party chart with legal status, addresses and authority documents.
- Create a transaction chronology tied to contracts, invoices, correspondence and performance records.
- Calculate the claim and identify the contractual or statutory basis of each component.
- Record limitation events, acknowledgments, part-payments and certified or registered documents.
- Separate final relief from injunction, receiver, security, disclosure or preservation requests.
- Prepare legible, searchable and consistently numbered annexures.

The Court publishes gazette notifications, including amendments concerning Original Side rules, and separate Commercial Courts Practice Directions. The Court also publishes current e-filing notices; fresh Commercial Division and Commercial Appellate Division filings have specific electronic-filing requirements.

Keep the principal contract or instrument, amendments, invoices, payment records, notices, acknowledgments, corporate authorisations, property papers if relevant, arbitration or jurisdiction clause, limitation events and a calculation of the amount or relief ready.
