Civil Appeal Before the Calcutta High Court: Record, Grounds and Preparation

A civil appeal is a challenge to an appealable judgment, decree, or order through the procedure allowed by law. Preparation begins with the exact decision, the issues framed, the evidence already on record, the findings reached, the error alleged, the appellate forum, and the limitation position.

Confirm that the decision is appealable

Not every adverse observation or procedural direction has the same appellate route. Review whether the challenge is to a decree, an appealable order, or another decision for which the law provides a different remedy. Also confirm whether the matter belongs before a District Court, the Calcutta High Court, a commercial appellate forum, or another statutory forum.

Read the judgment against the pleadings and issues

Separate findings of fact, conclusions of law, evidentiary rulings, procedural decisions, and the final relief. Then compare them with the plaint, written statement, framed issues, admissions, exhibits, depositions, and submissions. Effective grounds identify a reviewable error and explain its effect on the result; they should not simply repeat the entire trial narrative.

Build a complete and usable appellate record

  • Certified copy of the judgment and decree or appealable order
  • Plaint, written statement, counterclaim, and amendments
  • Issues, applications, interim orders, and connected-case details
  • Exhibits, deposition records, admissions, and relevant objections
  • Date-wise chronology, copy-application details, and limitation notes
  • Material needed for any stay or interim-protection request

Missing or inconsistent records can delay drafting, filing, or consideration of interim relief. The decree and operative directions should be checked carefully against the judgment.

Compute limitation immediately

Limitation should be examined as soon as the decision is pronounced or received. The applicable period and any exclusion of time depend on the type of appeal, forum, certified-copy process, governing statute, and facts. Do not assume that correspondence, settlement talks, or an intended review automatically protects the appeal deadline.

A filed appeal does not automatically stay the decision

Under the civil appellate framework, filing an appeal does not by itself suspend operation or execution of the decree or order. Where stay or other interim protection is necessary, the application should address the threatened prejudice, promptness, security or conditions where relevant, and the legal requirements applying to the requested order.

New evidence at the appeal stage is restricted

An appeal is ordinarily decided on the record created below. Additional evidence is not a routine opportunity to repair gaps in the trial. Any request to introduce further material must fit the legal conditions and explain why the evidence was not available or admitted earlier and why it is necessary for deciding the appeal.

Prepare focused grounds and relief

Possible issues may concern jurisdiction, interpretation of law or contract, failure to decide a material issue, reliance on inadmissible material, disregard of material evidence, procedural unfairness, or relief inconsistent with the findings. The grounds and prayer should match the appellate court’s powers and the actual record.

Check current Calcutta High Court procedure

Filing category, paper books, certified copies, affidavits, service, court fees, e-filing, defect removal, listing, and bench determination should be verified from current rules and notices. Commercial and statutory appeals may have additional requirements.
