A contested divorce requires more than proof of marriage and separation. The petition or defence must be built around the personal law that applies, legally relevant facts, admissible and lawfully obtained evidence, the correct Family Court, and any urgent financial, child-related, residence, or safety issue.

Understand what makes the case contested

A matter is contested when one party seeks relief that the other does not accept, disputes the legal ground or facts, raises a defence or counterclaim, or disagrees about connected issues. It is different from a mutual-consent divorce, which depends on continuing agreement and compliance with the applicable legal conditions.

Identify the precise relief sought and the facts said to support it. Separate allegations that may form part of the legal ground from background conflict that does not change the legal test. A date-wise chronology helps the lawyer compare each material statement with the available record.

Prepare the core case file

  • Marriage certificate or other proof of marriage, photographs, and address records
  • A concise chronology of cohabitation, significant events, separation, and later communications
  • Existing petitions, complaints, notices, mediation records, and court or police orders
  • Messages, emails, call records, photographs, medical material, or other evidence lawfully held
  • Income, employment, bank, tax, property, loan, rent, and household-expense records where relevant
  • Children’s school, health, residence, caregiving, travel, and existing access arrangements
  • Witness names with a short note explaining what each person directly knows

Keep original electronic records and complete conversations where possible. Do not edit screenshots, access another person’s account without authority, coach a witness, or publish private matrimonial allegations online. Matrimonial proceedings may involve statutory privacy protections, but documents should still be handled carefully.

Identify interim needs early

The final divorce issue may not be the only immediate concern. Clarify whether any application is needed regarding litigation expenses, interim maintenance, child custody or access, residence, protection, preservation of property, or compliance with an existing order. The available route depends on the applicable statute and facts, and some issues may already be pending in another proceeding.

Create a realistic monthly budget supported by records. For children, focus on current care, schooling, health, routine, communication, and practical arrangements rather than treating access as a bargaining point. Disclose every connected case so inconsistent statements or overlapping orders can be identified before filing.

Plan the petition, response, and evidence

A petition should state the material facts supporting the legal ground and the relief requested. A response should answer the pleaded case accurately, preserve available objections, and identify any counterclaim or separate relief requiring advice. Avoid exaggerated dates or absolute statements that the documentary record cannot support.

Evidence strategy should be prepared from the pleadings, not added as an afterthought. Map each disputed fact to a document, witness, admission, or other lawful source. Mark what is confirmed, what is disputed, and what still needs verification. The court will decide the case on the applicable law and evidence, not on the volume of screenshots alone.

Settlement can remain possible

A contested case may still be negotiated, mediated, or settled if both parties reach informed and workable terms. Settlement discussions should address the full case inventory and should not assume that one payment or a generic “full and final” sentence resolves every proceeding, child-related issue, property question, or future obligation.
