Cross-Examination Preparation in a Kolkata Criminal Trial
Cross-examination is not a performance or a catalogue of every contradiction. Each witness should be approached with a defined objective: limit personal knowledge, test identification, expose a material inconsistency, establish an omitted fact, challenge collection or support the defence sequence.
Witness file
Compare every prior version before drafting questions
Collect the witness’s complaint, statement, examination-in-chief, documents attributed to them and any reliable contemporaneous record. Under the Bharatiya Sakshya Adhiniyam, 2023, relevance, prior statements and proof rules shape what can be asked and how a contradiction may be proved. A question should not be used merely because it sounds forceful.
Capacity
Test where the witness was, what they could perceive and what they learned from others.
Chronology
Compare times, sequence, delay, opportunity and later additions against objective records.
Identification
Examine prior familiarity, viewing conditions, description, procedure and contamination risk.
Documents
Clarify authorship, custody, signatures, completeness, source and unexplained alterations.
Question design
Use short propositions tied to a purpose
Group questions by issue and decide the fact sought from each sequence. Avoid combining several propositions, arguing with the witness or revealing a document before the foundation is ready. Preserve the exact portion needed for a contradiction and understand the procedural method for putting it.

- Mark the supporting page and line in the brief.
- Separate essential admissions from optional credibility points.
- Prepare for likely answers without scripting testimony.
Trial integration
Connect answers to the overall defence theory
After each witness, update the evidence chart and identify what remains to be proved. Cross-examination is one component of the broader criminal trial defence plan; it should not accidentally admit an element or undermine another witness strategy.
File review
Bring the witness’s complete prior record
Share the complaint, statements, examination already recorded, exhibits, objective timeline, relevant electronic or forensic material and the defence proposition that each witness is expected to address.
