Domestic Violence Legal Remedies in Kolkata: Protection, Residence and Evidence
Domestic-violence matters can involve immediate safety, housing, finances, children, evidence, and parallel criminal or family proceedings. The first step is to separate urgent protection from the longer legal strategy.

What the 2005 Act addresses
The Protection of Women from Domestic Violence Act, 2005 defines domestic violence broadly and creates a civil-protection framework for an aggrieved woman in a domestic relationship. Depending on the evidence and circumstances, applications may concern protection, residence, monetary relief, temporary custody, compensation, and interim or ex parte orders.
The Act does not make every disputed allegation automatically proved. The conduct, relationship, jurisdiction, evidence, prior orders, and response all require careful review.
Immediate safety and legal preservation
- Move to a safer place if remaining at the location creates immediate risk.
- Contact 112 for an emergency and 181 for the national women’s helpline where appropriate.
- Preserve medical papers, photographs, messages, call logs, financial records, and existing complaints without editing the originals.
- Record dates, locations, witnesses, children present, injuries, threats, and property or financial events.
- Keep copies of any protection, bail, maintenance, custody, residence, or matrimonial order.
Protection, residence, money, and children
A useful consultation should identify the exact immediate need. A person may require protection from further conduct, access to a shared household, alternate accommodation or rent-related relief, medical or household expenses, temporary child arrangements, or compensation. These remedies have different factual and evidentiary foundations, so an application should not use a generic list without connecting each request to the record.
Evidence that helps the court understand the case
Prepare a concise chronology with supporting documents beside each event. Useful material may include contemporaneous messages, medical treatment, police or protection-officer records, bank statements, proof of shared residence, income and expense papers, school or medical records for children, witness details, and prior pleadings. Explain missing evidence honestly; do not manufacture screenshots, coach witnesses, or access another person’s accounts.

Do not ignore a notice or breach an existing order. Collect the complete application, service record, annexures, earlier proceedings, communications, financial documents, and a dated response to each material allegation. A response should address safety and lawful compliance while preserving objections to jurisdiction, facts, relief, or duplication of proceedings where available.
