First response

Separate immediate safety from document preparation

Use the emergency channel where a person, child, property or evidence faces immediate danger. A legal drafting review is not a substitute for urgent police, medical or protective assistance. For a non-emergency complaint, preserve the first version, supporting material and proof of submission.

Section 173 BNSS addresses information in cognizable cases

The Bharatiya Nagarik Suraksha Sanhita, 2023 has applied from 1 July 2024. Section 173 deals with information relating to a cognizable offence, including electronic communication subject to the statutory process. Whether particular facts require registration, preliminary handling or another route depends on the information supplied and the governing law; not every grievance automatically becomes an FIR.

Jurisdictional uncertainty should be described rather than hidden. Identify every location connected with the occurrence, communication, delivery, payment, injury or discovery of loss so the receiving authority can evaluate the territorial facts from the complaint itself.

Preserve the original context, not only screenshots

Electronic records can become important at investigation and trial. Sections 61 to 63 of the Bharatiya Sakshya Adhiniyam, 2023 address electronic or digital records and the statutory certificate framework. Keep original devices where possible, export complete conversations, preserve file names and dates, and note who collected each item.

The official Bharatiya Sakshya Adhiniyam text should be checked against the intended use. Do not crop away participants, remove unfavourable messages, alter metadata or circulate sensitive material more widely than necessary.

After submission

Track the response and preserve each later step

  1. Keep the diary, acknowledgment or portal number and the complete filed set.
  2. Note calls, visits, assigned officers and requests for further documents.
  3. Obtain and preserve the FIR copy or status information available through the lawful channel.
  4. Record any threat, retaliation or fresh incident separately and promptly.
  5. Review the statutory supervisory or court route if the response remains disputed.

If the complaint creates a concrete apprehension of arrest for the person seeking advice, the issue may require a separate anticipatory bail assessment. If a trial is already pending, use the criminal trial defence service to organise the court record.
