Classify the tenancy before sending a notice

The West Bengal Premises Tenancy Act, 1997 contains provisions on covered premises, rent, deposits, duties and recovery of possession, but its application depends on statutory definitions, exclusions and facts. The written agreement, commencement date, monthly rent, permitted use and identity of the landlord and tenant must be checked rather than assumed.

The Transfer of Property Act, 1882 also contains general lease provisions. Commercial arrangements, high-rent premises, licences, company occupation and government or public premises may require a different analysis. Calling an arrangement a “licence” does not by itself settle its legal character.

A notice should state the correct relationship, default, period and relief. Overstating arrears, omitting accepted payments or relying on an inapplicable clause can complicate the proceeding. A tenant replying should identify factual errors and preserve proof without making unnecessary admissions.

  1. Confirm whether the immediate objective is payment, access, repair, restraint, renewal, surrender or possession.
  2. Check notice requirements, contractual cure periods, statutory conditions and any pending rent-control or civil proceeding.
  3. Calculate arrears transparently and separate rent from maintenance, utilities, interest, damage and deposit adjustments.
  4. Assess settlement terms for payment, vacant handover, inventory, key return, meter readings, deposit refund and withdrawal of cases.
  5. If litigation is necessary, prepare the correct forum, pleadings, service proof and evidence plan.

Lockouts, utility disconnection, removal of goods, threats or forced entry can create urgent legal and evidentiary problems. Neither side should treat disputed possession as permission for self-help. Safety issues and criminal allegations should be documented and routed separately where necessary.

Settlement should be recorded with the same care as a contested claim. State the admitted balance, payment dates, use until handover, inspection access, treatment of the deposit, condition of fixtures, disposal of goods and the evidence that ends each side’s obligations. Avoid relying on an informal promise to vacate or refund later.
