Financial support proceedings

Maintenance and Alimony Lawyer in Kolkata

Maintenance disputes require a reliable picture of income, reasonable needs, dependants, liabilities and the relief already claimed or awarded in other proceedings. The correct application depends on the relationship, governing law, pending matrimonial case and whether interim support, litigation expenses, long-term alimony, child support or enforcement is required.

Choose the remedy

Interim support and final alimony are different questions

Where the Hindu Marriage Act applies and a matrimonial proceeding is pending, section 24 concerns maintenance during the proceeding and litigation expenses, while section 25 concerns permanent alimony and maintenance. Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023 provides a separate summary maintenance route for persons within its scope. The Protection of Women from Domestic Violence Act, 2005 also permits monetary relief in a qualifying domestic-violence case.

These remedies should not be treated as interchangeable. The application must disclose connected maintenance proceedings and existing orders so the court can avoid inconsistent or duplicative relief. Current statutory materials include the Ministry of Home Affairs’ official BNSS text and the Legislative Department’s Hindu Marriage Act entry.

Disclosure file

Build a financial record that can be tested

Income trail

Collect salary records, tax returns, business accounts, bank statements, professional receipts, rent, investments and evidence relevant to actual earning capacity.

Monthly needs

Prepare a realistic schedule for housing, food, utilities, transport, medical care, education, childcare and other recurring requirements, supported where possible.

Assets and debts

List real property, vehicles, securities, valuable interests, loans, instalments and genuine dependant obligations rather than presenting only a selected balance.

Existing orders

Provide every interim or final maintenance order, payment proof, arrears calculation and pending application across all connected courts.

Supreme Court framework

There is no single percentage formula

In Rajnesh v. Neha, the Supreme Court issued directions on overlapping jurisdictions, financial disclosure, relevant factors, commencement of maintenance and enforcement. The judgment provides affidavit formats for disclosure of assets and liabilities and explains that the assessment is fact-sensitive rather than a fixed mathematical rule.

Relevant considerations may include the parties’ status, reasonable requirements, independent income, childcare responsibilities, marriage duration, standard of living, employment history, liabilities and the paying party’s capacity. The final figure and effective date remain judicial decisions based on admissible material.

Business and self-employment income often requires more than a tax-return figure. Bank movement, drawings, company or partnership interests, benefits paid through an entity, asset acquisition and the difference between business turnover and personal income should be explained carefully. A court may test whether claimed expenses are genuine operating costs or personal expenditure.

Application and response

Present the same financial story across connected cases

  1. Create a chronology of marriage, separation, employment changes and earlier support requests.
  2. Prepare the applicable asset-and-liability disclosure with source documents.
  3. Explain unusual credits, cash withdrawals, business expenses or claimed loan obligations.
  4. Identify child-related expenditure separately from personal expenditure.
  5. Reconcile prior awards and payments before calculating alleged arrears.
  6. Seek variation or enforcement through the legally appropriate proceeding rather than informal self-adjustment.

Applicants should avoid inflated or unsupported schedules. Respondents should not conceal income, divert receipts or rely only on a current salary figure where the broader record shows other resources. Either approach can damage credibility.

Consultation file

Send records for a month-by-month review

Provide pleadings and orders, twelve months of relevant bank statements, recent tax and income material, a monthly expense schedule, property and loan documents, school and medical records for dependants and a payment ledger. For separation terms, see the settlement and mediation service.
