Matrimonial Settlement Agreement in Kolkata: Clauses to Review
A matrimonial settlement should convert negotiated points into precise, lawful, and workable obligations. It must identify every relevant proceeding, payment, property or article, child-related arrangement, filing step, deadline, and document needed to implement the agreement.

Create a complete dispute and case inventory
Before drafting, list every petition, complaint, appeal, maintenance case, custody or access proceeding, protection proceeding, criminal case, civil dispute, police complaint, mediation, and legal notice between the parties or connected with the settlement. Record the forum, case number, present stage, next date, interim orders, and the exact step proposed for each matter.
An agreement should not say only that “all cases will be withdrawn” when different forums use different procedures or when an order requires a particular application. The settlement should identify who will take each step, in what sequence, on which date or event, and what proof will be exchanged.
Define payments and financial disclosure
- State whether each amount relates to maintenance, alimony, return of money, litigation costs, property adjustment, or another obligation.
- Separate principal amounts, instalments, due dates, mode of payment, bank details, and acknowledgement of receipt.
- Specify whether payment occurs before, at, or after a filing, statement, decree, handover, or withdrawal.
- Address existing interim maintenance, arrears, loans, insurance, tax, and shared liabilities where relevant.
- Identify what happens if a payment is delayed, fails, or is disputed.
Do not use a broad payment clause without checking whether the figure and timing match every case and order. Each party should understand what is being settled and what, if anything, remains outside the agreement.
Describe property, documents, and articles precisely
For movable articles, jewellery, documents, vehicles, or household goods, use an inventory and describe the handover condition, place, date, and acknowledgement. For land, a flat, company interest, account, investment, or secured asset, identify the exact asset and obtain specialist advice on title, transfer documents, lender consent, registration, stamp duty, tax, possession, and existing encumbrances.
A settlement statement is not automatically a substitute for every deed, registration, corporate approval, or third-party consent needed to complete a transfer.
Draft child-related arrangements around practical detail
Where children are involved, address present residence, school routine, healthcare, holidays, travel, communication, handover locations, expenses, information sharing, and how later changes will be discussed. Child-related terms remain subject to the applicable law and the court’s assessment; they should not be treated as a penalty or bargaining device.
Avoid vague expressions such as “reasonable access” if the parties already disagree about timing or handover. At the same time, build enough flexibility for school calendars, illness, emergencies, and the child’s changing needs.
Sequence consent, filings, and case disposal
State which acts are simultaneous and which depend on an earlier step. Examples may include signing, first payment, return of articles, filing a joint application, making statements, seeking disposal of specified cases, completing a property document, and final payment. The sequence should reduce the risk that one side completes all obligations while the corresponding step remains undefined.
Settlement and conciliation are recognised features of Family Court procedure, but the court and each forum retain their legal functions. Counsel should verify which terms can be recorded, which applications are required, and whether any proceeding cannot be concluded by private wording alone.
Include proof, communication, and default terms
Specify acceptable delivery methods, addresses and email identifiers, payment proof, signed receipts, and the person responsible for preparing or filing each document. Define the response to non-performance without using unlawful threats or clauses that attempt to prevent a person from approaching a court or authority where the law permits it.
Confidentiality and non-disparagement clauses should be reviewed carefully. They should not require concealment from a court, tax authority, police, child-protection body, or professional adviser where disclosure is lawful or required.
Review checklist before signing
- Does the agreement list every case, order, asset, payment, article, and child-related issue?
- Are names, case numbers, amounts, dates, and property descriptions accurate?
- Is every obligation assigned to a person and linked to a deadline or event?
- Are withdrawal, disposal, consent, and transfer steps legally possible in the stated form?
- Has each party had the opportunity for independent, informed legal review?
