Temporary Injunction in Kolkata: Evidence and Urgent Court Preparation
A temporary injunction asks a court to preserve rights or prevent serious harm before the civil dispute is finally decided. The application must connect a recognizable legal right, a real and immediate threat, the comparative hardship and a precise form of interim protection.
Legal information notice: This article provides general information. The correct proceeding, forum, notice procedure, evidence and relief depend on the facts and current law.
What interim protection is meant to do
Interim relief may be considered where a threatened transfer, dispossession, construction, demolition, disclosure, breach of a negative covenant or disposal of disputed assets could make the final decision ineffective. It is not a shortcut to final relief and should be framed no wider than the immediate risk requires.
Core questions the evidence should answer
- Prima facie right: Which document, possession record, contract or legal relationship supports the claim?
- Immediate threat: What is about to happen, who will do it, and what dated evidence shows urgency?
- Irreparable injury: Why may damages or later relief be inadequate for the threatened harm?
- Balance of convenience: Which temporary arrangement causes less injustice while the case is decided?
- Conduct: Was there delay, concealment, acquiescence or an inconsistent earlier position?
Build an emergency evidence packet
| Issue | Useful records |
|---|---|
| Ownership or entitlement | Deeds, agreement, allotment, licence, corporate record or prior order |
| Possession or performance | Tax and utility records, photographs, delivery records, site material or correspondence |
| Threat | Notice, message, advertisement, proposed transaction, work activity, police diary or dated photograph |
| Urgency | Next transaction date, demolition schedule, hearing, expiry, transfer step or other fixed event |
| Comparative hardship | Evidence of the effect of granting or refusing short-term protection |
Prepare originals and a legible indexed set. Electronic records should retain source, date and surrounding context.
Draft the relief precisely
State the act to be restrained or the position to be preserved, the property or obligation involved, the parties bound, and the period or procedural stage for which relief is requested. Vague prayers create enforcement problems; overbroad prayers can undermine proportionality.
Notice, urgent hearing and full disclosure
Whether the other side receives advance notice depends on the procedural setting and urgency. A request made without prior notice requires careful, complete disclosure of material facts, including adverse documents and earlier proceedings. The applicant should also be ready to comply promptly with directions about service, affidavits, documents and the next hearing.
After an interim order
- Read the operative directions and time limits carefully.
- Complete service and filing steps ordered by the court.
- Preserve proof of compliance and any alleged breach.
- Avoid interpreting the order more broadly than its wording.
- Prepare the main case; interim relief does not replace pleadings and evidence.
