A bid can fail before price comparison if a mandatory declaration, prescribed format, credential, security instrument, digital-signature step or deadline is missed. Pre-bid legal review converts the tender pack into a working compliance plan so the commercial team knows what must be proved, who must sign it and when the portal action must be completed.

Turn every eligibility clause into a verifiable task
The review starts with the notice inviting tender, instructions to bidders, scope, qualification criteria, schedules, forms, contract conditions and every corrigendum. Each requirement is tagged as mandatory, conditional, informational or commercial, then matched to the document or portal step that demonstrates compliance.
Bidder identity
Check registration, constitution, authorised signatory, power of attorney, joint venture or consortium documents and any conflict or non-blacklisting declarations.
Experience and capacity
Match work orders, completion certificates, turnover, net worth, equipment, staff and similar-work requirements to the precise look-back period and value formula.
Forms and securities
Verify prescribed formats, validity periods, amounts, issuing bank details, stamp or notarisation requirements and whether deviations are permitted.
Technical response
Cross-reference specifications, drawings, methodology, schedules and offered deviations so the evaluator can locate the answer in the submitted set.
Electronic submission
Portal evidence is part of the tender record
For an e-tender, legal sufficiency and successful uploading are different questions. Preserve the portal notice, bidder dashboard, hash or acknowledgment, upload list, payment or EMD record, time stamp and final submission confirmation. Use only the prescribed file type and naming convention; do not alter a protected BOQ template merely to make it easier to complete.
- Download the full tender and all published corrigenda from the issuing portal.
- Create a responsibility sheet for legal, technical, finance and portal owners.
- Complete digital-signature, enrolment and security steps well before closing time.
- Run a final comparison between the uploaded set and the clause matrix.
- Save the final acknowledgment and a read-only copy of every submitted file.
The Government of West Bengal publishes bidder material through its eProcurement manual kit and has introduced a new e-Tender portal. The portal named in the live tender and its current instructions control the actual submission.
Clarifications and deviations
Resolve ambiguity before it becomes a rejection ground
A pre-bid question should identify the clause, explain the ambiguity and seek a usable response without rewriting the bidder’s proposal. If an answer changes scope, eligibility, dates or formats, check whether the authority issues a formal corrigendum. Private emails or verbal assurances should not be treated as substitutes for an amendment visible to all bidders.
The Department of Expenditure’s 2024 procurement manual describes transparent evaluation against declared tender conditions and warns against overlooking significant requirements. The exact tender, applicable rules and issuing authority remain decisive.

What to expect from the pre-bid file
