Start with the tender record, not only the rejection
A government tender dispute should be reviewed against the complete procurement record: the notice inviting tender, eligibility conditions, corrigenda, bid submission, evaluation material available to the bidder, communications, rejection reason and the current stage of award or contract execution.

Document checklist
Preserve the complete bid and evaluation trail
- Notice inviting tender and all schedules/annexures.
- Corrigenda, clarifications and pre-bid communications.
- Eligibility, technical and financial criteria relied upon.
- The submitted bid, upload acknowledgements and portal screenshots.
- EMD, bid-security or performance-security documents where relevant.
- Technical evaluation, deficiency notice, rejection or disqualification communication.
- Representations already made and proof of delivery.
- Award information, letter of intent or public result available to the bidder.
- A date-wise chronology including standstill, award or contract deadlines.
Classify the issue
Common tender disputes need different review
Eligibility or technical rejection
Compare the exact tender clause with the document relied upon by the bidder and the stated rejection reason. Keep the original submitted file and portal acknowledgement.
Evaluation or scoring dispute
Identify the published methodology, the bidder’s submission, any available score or evaluation communication and the specific inconsistency alleged.
Blacklisting or debarment risk

Award, cancellation or re-tender
Record whether the award is complete, whether a contract has been signed, the reasons communicated for cancellation or re-tender and what immediate prejudice is alleged.
Urgency and remedy
Separate the final challenge from immediate interim protection
Where an award, opening of bids, execution of a contract, blacklisting order or other time-sensitive procurement step is imminent, record the exact date and requested interim protection. The available forum and remedy depend on the tender authority, contractual stage, governing procurement framework, alternative remedies and facts.

Prepare a one-page case summary
- Name the tendering authority and tender reference.
- State the disputed clause or procurement step.
- Quote the reason communicated for rejection, disqualification or adverse action.
- List the documents in your bid that address that issue.
- Identify the next procurement deadline or threatened action.
- State the practical relief required now and the final outcome sought.

Should I send only the rejection letter?
No. The tender terms, corrigenda, submitted bid and chronology are usually necessary to understand whether the rejection or evaluation issue is actually inconsistent with the procurement record.
Does every tender dispute require a writ petition?
No. The correct route depends on the authority, stage, tender framework, available representations or remedies, urgency and the nature of the alleged legal error.
What matters most in an urgent review?
The complete tender clause, the bidder’s submitted material, the impugned communication and the next award/contract deadline should be identified first.
