MSME Payment Recovery in Kolkata: MSEFC Evidence and Options
An unpaid MSME invoice should be assessed as both a statutory and contractual recovery problem. The first review should confirm enterprise status, supply and acceptance, agreed credit, objections raised, the payment trail, limitation and the forum that fits the documents.

Confirm the business and transaction record
- Udyam or earlier registration records and their relevant dates
- Purchase order, work order, contract, rate approval and specifications
- Invoice, e-invoice, tax record and ledger
- Delivery challan, transport record, completion certificate or service acceptance
- Email, portal entry, meeting record or message acknowledging supply
- Debit note, quality objection, rejection or set-off raised by the buyer
- Part-payment, balance confirmation or promise to pay
Do not treat an invoice alone as proof of every element. Link each invoice to the order, supply, acceptance and outstanding balance.

Compare the available routes
- Commercial notice and negotiation: useful when the record is clear and the relationship may be preserved.
- MSE Facilitation Council route: the delayed-payment framework provides for reference, conciliation and further adjudicatory steps subject to the Act and eligibility.
- Contractual arbitration: review the arbitration clause, seat, appointment process and interaction with statutory remedies.
- Civil or commercial proceeding: assess jurisdiction, limitation, threshold, summary procedure and interim protection.
- Insolvency-related options: require separate eligibility and strategic review; they should not be used as a generic debt-collection threat.
Prepare an MSEFC-ready file
- Create a party and contract summary.
- Prepare an invoice schedule with supply, acceptance, due date and payment fields.
- Index purchase orders, invoices, delivery proof and correspondence.
- Explain every buyer objection and the supplier’s response.
- Separate principal and interest calculations.
- Disclose related arbitration, suit, insolvency or settlement proceedings.
- Verify the current online filing and Council requirements before submission.
