Probate becomes more complex when an executor or heir lives abroad, the deceased was domiciled outside India, or assets are spread across states or countries. The first task is to map each jurisdiction and the authority required there.
1. Map domicile, residence and assets
Record the deceased’s permanent home, last residence, citizenship, property locations and asset types. Different rules may govern movable and immovable property.
2. Identify every existing grant
Check whether probate or administration has already been granted in another Indian state or foreign country. Do not assume an overseas grant automatically authorises dealings in West Bengal.
3. Select the Indian procedure
Depending on the facts, the work may involve an original grant, an ancillary proceeding, production of an authenticated foreign grant, additional statements under section 279 or other relief. The correct route requires document-specific advice.
4. Prepare cross-border documents
- Original will and death certificate.
- Foreign grant and court papers, if any.
- Passport, domicile and address evidence.
- Proper apostille, legalisation or consular authentication where required.
- Certified translations for non-English records.
- Indian asset schedule and valuations.
5. Arrange representation and signatures
An NRI may use a properly drafted and authenticated power of attorney for permitted acts, but personal verification, evidence or court attendance may still be required. Broad generic powers often create avoidable objections.
6. Coordinate tax, banking and transfer compliance
Probate authority does not replace tax, foreign-exchange, company, depository, banking or land-registration requirements. Build a coordinated completion plan.

Residence abroad does not automatically disqualify an executor, but practical, regulatory and security requirements must be assessed.
Will a UK or US probate work in Kolkata?
