Tenant Eviction in Kolkata for Non-Payment of Rent: Legal Starting Points
A rent-default dispute should start with the applicable tenancy regime, the contract, a reliable payment ledger, notice requirements, and the lawful route to possession—not self-help measures.

First determine which legal regime applies
The West Bengal Premises Tenancy Act regulates specified premises in Kolkata, Howrah, and other covered municipal areas, but it contains exemptions and limits. Some leases or occupations may instead be governed principally by the Transfer of Property Act, the contract, or another special law. Before sending a notice, confirm the property, purpose, monthly rent, execution and registration of the lease, parties, and any exemption.
Build a defensible rent ledger
Record each rental period, rent due, maintenance or tax components, payments received, mode of payment, receipts issued, deposits held, adjustments claimed, and the balance disputed. Match the ledger to bank entries, receipts, messages, and the agreement. Do not combine unrelated repair, deposit, electricity, or damage claims without explaining their legal basis.
Non-payment under the 1997 Act
The official text identifies rent default as one of the statutory grounds that may support recovery of possession in covered cases and also contains provisions concerning payment or deposit of arrears during proceedings. The dates and number of defaults matter. A lawyer should check the latest text, amendments, and decisions rather than relying on a remembered threshold.
Notice and filing preparation
- Lease, tenancy agreement, renewal, and registration records
- Ownership or authority documents showing who may act as landlord
- Complete rent ledger, receipts, bank statements, and deposit details
- Prior demands, notices, replies, returned mail, and service evidence
- Property description, use, occupants, subletting allegations, and inspection records
- Any repair, essential-service, fair-rent, deposit-of-rent, or parallel proceeding
The notice should match the applicable law and contract, state the default accurately, and avoid demanding amounts that the documents cannot support.
Avoid unlawful self-help
Do not change locks, remove belongings, disconnect essential services, threaten occupants, or attempt physical eviction outside lawful process. These steps can create separate civil or criminal exposure and may weaken the possession case. Preserve the property and proceed through the forum and procedure that apply.
If you are responding as tenant
Do not ignore the notice or summons. Gather payment proof, receipts, bank records, money-order or deposit records, repair communications, service complaints, and the complete agreement. Calculate the undisputed and disputed amounts separately. Time-sensitive deposit or payment provisions may apply during a proceeding, so obtain advice promptly.
