Calcutta High Court Appeal: Documents, Limitation and Stay Checklist
Before preparing an appeal, first identify what order or judgment is being challenged, which statute or procedural code creates the appellate route, the correct side or bench, the limitation position and whether interim protection is required. Civil appeals, criminal appeals and statutory appeals should not be treated as the same filing.
Start with the impugned order and source of appeal
Obtain the complete judgment or order and note the case number, court or tribunal, date of pronouncement, date of receipt or certified-copy application where relevant, parties and operative directions. Then identify the provision under which an appeal is proposed rather than assuming that every adverse order is immediately appealable.
Build an appeal-ready record
- Impugned judgment or order and relevant certified-copy details.
- Pleadings, applications and affidavits material to the issues proposed in appeal.
- Evidence, exhibits and documents relied upon by the lower forum.
- Orders affecting interim relief, costs, execution, bail or compliance.
- A date-wise limitation note including copy-application and receipt dates where relevant.
- A concise list of proposed grounds tied to the findings or directions being challenged.
Separate grounds from a repetition of the original case
An appeal should engage with the decision under challenge. Identify the finding, legal interpretation, procedural ruling or evidentiary assessment said to require appellate intervention and connect it to the record. A general statement that the earlier court was “wrong” does not replace a ground directed to the judgment.
Interim protection is a separate question
Filing an appeal does not always suspend the effect of the challenged order. Depending on the proceeding, a stay, suspension of sentence, bail, status quo or another interim application may require separate facts and legal grounds. Identify the concrete prejudice that may occur before the appeal is heard and prepare the supporting record.
Check the current Court record and notices
Use the Calcutta High Court official website for current notices, case information and court resources. Filing requirements, roster/determination and procedural directions should be verified for the particular appellate route.

Calcutta High Court appeal FAQs
What document should be reviewed first?
The complete order or judgment under challenge. The appeal route and grounds cannot be assessed reliably from a short case-status entry alone.
Should limitation be checked before drafting grounds?
Yes. Record the relevant order, pronouncement and copy dates immediately and assess limitation under the law governing the particular appeal.
Does filing an appeal automatically stay the order?
Not necessarily. Interim protection may require a separate application and supporting facts depending on the type of proceeding.
Last reviewed: 26 September 2026. General legal information only; appealability, limitation, forum and interim relief depend on the order and governing law.
