Questions to answer before choosing the suit route
- Who are the necessary parties? Identify the contracting entities, guarantors, agents and any person against whom relief is actually required.
- What is the principal cause of action? Separate contractual breach, recovery, property, injunction or other relief rather than combining unrelated grievances.
- What is the limitation position? Record the relevant dates, acknowledgements, payments and prior proceedings before relying on a limitation calculation.
- Is there an arbitration clause? Review whether the contract sends the dispute to arbitration and whether interim court relief is the more appropriate immediate route.
- Is urgent interim protection required? Identify the asset, payment, restraint, preservation or status-quo relief needed and the evidence supporting urgency.
